Cintra US Services, LLC (“Cintra”, “we”, “us”, or “our”) respects your privacy and is committed to maintaining it through adherence to this privacy statement (this “Statement”).  An affiliate of Cintra is a member of a consortium, “Georgia Express Link Partners.” Cintra has developed this Statement to describe how we may collect information about you through your interactions with us, on our website, http://www.georgiaexpresslink.com/, and any mobile versions (collectively, the “Site”), from third parties that provide data to us, or through your interactions with us (collectively, the “Services”), how we use information, and how and under what circumstances we share that information.

When you submit information to us or through the Site, you consent to the collection and processing of your information as described in this Statement.  Please read this Statement carefully, together with all other documents we may provide to you, to understand our policies and practices regarding your information and how we will treat it.  In the event of a conflict between this Statement and any other document we provide to you, the terms of this Statement will govern. If you do not agree with any part of this Statement, please do not use our Site or provide any Personal Information (defined below) to us.

We may change this Statement from time to time. The “Effective Date” legend at the top of the page indicates when this Statement was last revised.  Any changes will become effective when we post the revised Statement on the Site. Your continued use of the Site following these changes means that you accept the revised Statement.  If we significantly change how we handle your Personal Information, we may provide more prominent notice or obtain your consent as may be required by law.  If you do not wish to accept the changes, you should cease using the Site.

This Statement does not apply to any information we collect, other than Personal Information collected from the sources discussed below. This Statement also does not apply to information about businesses or other non-individuals.

1. Information We Collect
Cintra collects information about you that reasonably allows us to identify you when you voluntarily request information from Cintra or supply information through the Site, including:

  • Information by which you may be personally identified, such as your name, e-mail address, mailing address(es), phone number(s), biographic information (e.g., gender, occupation, citizenship, level of education, and professional background and any other identifiable information that you choose to submit to us (“Personal Information”).
  • Information about your Internet connection, the equipment and browser you use to access our Site, usage details, the domain from which you link to the site, traffic data (e.g., Internet Protocol (IP) addresses), and information collected through “cookies” (“Usage Data”).

We collect this information:

  • Directly from you when you provide Personal Information to us (e.g., when you submit a question, or correspond with our Site by e-mail or other electronic messages), and
  • Automatically as you navigate through our Site through “cookies” and other tracking technologies. “Cookies” are small text files a website can use to recognize repeat users, facilitate the user’s ongoing access to and use of the website, and allow a website to track usage behavior and compile aggregate data that will allow content improvements.

2. How We Use Information
You agree that we may use your Personal Information as follows:

  • to provide you with the Services or information that you request from us;
  • to send you emails or other information that we believe may be of interest to you with your consent
  • for customer service, security, to detect fraud or illegal activities;
  • to prevent or investigate activity we think may be potentially illegal, unlawful or harmful;
  • for archival and backup purposes in connection with the provision of the Services;
  • to better understand how you access and use the Site, for the purposes of trying to improve the Site, diagnose problems, administer our Site and respond to your preferences;
  • to enforce our Site Terms (as defined in the Website Terms of Use page) or other applicable policies.

We also use Usage Data that we collect to operate, improve and personalize the Site, to provide customer service, and to detect, prevent and mitigate fraudulent or illegal activities.

3. Disclosing Your Information to Third Parties
Any information we gather, whether voluntarily provided by you or automatically collected, may be used for our internal business purposes and disclosed to third parties, as stated below.  We treat the Personal Information you submit to us as confidential. We may share Personal Information with other trusted companies or people to perform functions for which we engage them.  Other than to a buyer or successor of our business, Cintra does not sell or rent any Personal Information to third parties. Cintra also does not provide any information obtained through the Site to third parties for direct marketing purposes.

Notwithstanding any other statements or representations in this Statement or elsewhere on our Site, we reserve the right to disclose any information in our possession to our affiliates, the equity members in our consortium, and their affiliates and to the directors, officers, employees, agents, advisors, counsel and auditors of such persons (our “Representatives”) and to the extent required by any law, rule, regulation, stock exchange rule, subpoena, court order or any other similar judicial or legal process or in connection with any legal proceedings or otherwise requested by any governmental agency, regulatory authority (including, any self-regulatory organization claiming to have jurisdiction) or any bank examiner.

We may also share your Personal Information with third party vendors who provide services on our behalf.  These third party vendors include our site administrator, and other vendors who help us analyze our Site’s performance (such as Google Analytics).  Google Analytics uses cookies and collects information such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this site. Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other Personal Information. The information generated and collected by the cookies about your use of the Site will be transmitted to and stored by Google on servers in the United States. We do not combine the information collected through the use of Google Analytics with Personal Information that we collect from you. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser, or you can opt out by downloading a browser add-on here. We may also share Personal Information with the Georgia Department of Transportation (“GDOT”), or other parties with whom we have contracted to provide services in connection with our project, if reasonably necessary to respond to your questions. We may also authorize third party vendors to collect information on our behalf as necessary to maintain the functionality of the Site.

We may also transfer your Personal Information to our affiliates, and the equity partners of our consortium and their affiliates within or outside the United States.  Cintra also reserves the right to transfer Personal Information to a purchaser or successor entity in the event of a sale or other corporate transaction involving some or all of our business. To the extent we provide your Personal Information to any third parties, we will request that they use reasonable security measures to protect your information.

4. Security
We implement a variety of physical, technical and administrative security measures to maintain the safety of your Personal Information against unauthorized access, improper use or disclosure, unauthorized modification, and unlawful destruction or accidental loss.  However, the security of information transmitted through the internet can never be guaranteed.  We (like all websites) cannot warrant or guarantee 100% security of any information you transmit to us through the Site. We also encourage you to protect any usernames, passwords or other credentials you use to access the Site and to use a password that you do not use on any other website or with any other online services.

5. Managing “Do Not Track” Signals
Some browsers have a “Do Not Track” (“DNT”) feature that lets you tell websites that you do not want your online activities tracked.  When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity via cookies or other tracking technologies.  Cintra does not respond to DNT signals.

6. Third Party Links
The Site may contain links to websites maintained by third parties with which we have no affiliation.  This Statement does not reflect the privacy practices of those sites, and you should consult the privacy policies of those sites to learn about their practices.  A link to any third party site does not mean that we endorse it or the quality or accuracy of information presented on it, and we are not responsible for the privacy practices of such third parties.
Please note that if you sign up for alerts in connection with our project, or register for an E-ZPass and/or Peach Pass, you are providing Personal Information directly to GDOT and the Georgia State Road and Tollway Authority.  Cintra does not collect or retain that information, which therefore is not handled in accordance with this Statement.

7. Changing or Deleting Personal Data
We strive to maintain the accuracy of Personal Information collected.  We will work with you to correct or delete any information you submitted to us upon your request.  However, please note that we may be required (by law or otherwise) to keep certain information and not delete it, or keep such information for a certain amount of time (in which case we will comply with your deletion request, only after we have fulfilled such requirements).
If you do not wish to receive communications from us, you may opt-out of receiving them by e-mailing info@georgiaexpresslink.com.  However, please note that Cintra may continue to contact you as needed to respond to requests or inquiries from you, or for other administrative purposes relating to your use of the Services (e.g., updates to this Statement).

In addition, please note that certain alerts regarding our project are provided directly by GDOT, not by Cintra.  To stop receiving those alerts, please contact GDOT directly.

8. Children Under the Age of 13
Our Site is not intended for or targeted to children under the age of 13. Cintra does not knowingly or intentionally solicit or collect Personal Information from a child under the age of 13 through the Site without verifiable parental consent.  If we discover that a child under the age of 13 has submitted Personal Information without verifiable parental consent, we will delete that information. We recommend that children between the ages of 13 and 18 obtain their parents’ permission before submitting information to us over the Internet. By using our Services, you are representing that you are at least 18 years old.

9. California Residents
If you are a California resident under 18 years old and have an account with us or have linked to us through social media, you can request that we remove content or information that you have posted to our website or other online services. Note that fulfilment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user).
